These Terms of Use govern your access to KINKY.NZ, a New Zealand-focused adult advertising and directory portal. By visiting the site, opening a profile, submitting an advertisement or using any site feature, you agree to these Terms. If you do not agree, do not use KINKY.NZ.
1. Adults only
KINKY.NZ is intended only for people aged 18 or older who may legally view adult material in their location. You must leave immediately if you are under 18. We may restrict or refuse access where age, identity or legal eligibility cannot be reasonably established.
2. What KINKY.NZ provides
KINKY.NZ provides a directory in which independent advertisers and agencies can publish profile information. We provide advertising space and discovery tools; we are not an escort agency, employer, representative, booking service or party to any communication, arrangement, payment or meeting between users and advertisers.
A profile’s availability, identity, photos, services, prices, location and other statements are supplied by the advertiser. Labels such as “verified” refer only to the particular check described on the site and are not a guarantee of identity, conduct, legality, safety or service quality.
3. Lawful and responsible use
You may use the portal only for lawful purposes and in a manner consistent with New Zealand law and any law that applies to you. You must not use KINKY.NZ to exploit, coerce, traffic, harass, threaten, deceive or unlawfully discriminate against another person; facilitate services involving anyone under 18; publish intimate material without consent; impersonate another person; scrape or resell site data; disrupt the site; introduce malicious code; or attempt to bypass security controls.
4. Advertiser responsibilities
Each advertiser confirms that they are at least 18, are acting voluntarily, may lawfully advertise, and have the authority and consent needed for every image and statement submitted. Advertisements must be accurate, current, non-misleading and must not contain prohibited, abusive, infringing or illegal material.
Advertisers are responsible for their own tax, licensing, employment, health and safety, record-keeping and other legal obligations. Login details must be kept secure. You are responsible for activity carried out through your account and should notify us promptly if you suspect unauthorised access.
5. Visitor safety
Use independent judgment before contacting or meeting anyone. Confirm current details directly, protect personal information and never send money in advance to an unknown person. KINKY.NZ does not conduct comprehensive background checks and cannot supervise private communications or meetings. Report suspicious, coercive, underage or unlawful content through the contact page; contact emergency services where there is immediate danger.
6. Content and intellectual property
The KINKY.NZ name, visual design, software, compilation and original editorial material are protected by applicable intellectual-property laws. Except for ordinary personal browsing, you may not copy, republish, frame, distribute, reverse engineer or commercially exploit them without written permission.
You retain rights in content you submit. You grant KINKY.NZ a non-exclusive, worldwide, royalty-free licence to host, reproduce, resize, adapt and display that content as reasonably necessary to operate, promote and protect the portal. This licence ends when the content is removed, except for lawful backups, evidence and records we must retain.
7. Moderation, suspension and removal
We may review, edit, refuse, suspend or remove content or accounts where we reasonably believe these Terms, site rules, third-party rights or law may have been breached, or where action is needed to protect users or the portal. We are not required to publish an advertisement or provide advance notice in urgent cases.
8. Paid advertising
Prices, duration and placement for paid features are shown at purchase or agreed with the site administrator. Unless required by law or expressly agreed otherwise, fees for a placement that has already begun are non-refundable. We may refuse unlawful or non-compliant advertising and will address any statutory consumer rights that cannot legally be excluded.
9. Availability and third-party links
We aim to keep KINKY.NZ available but do not promise uninterrupted, error-free or permanent access. Features and listings may change or be withdrawn. External sites, messaging services and payment providers operate under their own terms and privacy practices; KINKY.NZ is not responsible for their content or operation.
10. Disclaimers and liability
To the fullest extent permitted by law, the portal is provided “as is” and “as available”. We do not endorse advertisers or guarantee profile accuracy, outcomes, compatibility or safety. KINKY.NZ and its operators are not liable for indirect or consequential loss, loss arising from private dealings between users, or matters outside our reasonable control. Nothing in these Terms excludes rights or liability that cannot lawfully be excluded under New Zealand law.
11. Changes and governing law
We may update these Terms to reflect changes to the portal, risk or law. The date above identifies the current version; continued use after publication means you accept the revised Terms. These Terms are governed by New Zealand law and disputes are subject to the courts of New Zealand, unless mandatory law requires otherwise.
